Naturalization

Naturalization is the process that a green card holder will go through in order to obtain their citizenship in the United States. The requirements for Naturalization are spelled out in the Immigration & Nationality Act and the best part of Naturalization is that it is a legal right of Lawful Permanent Residents – as long as you meet the requirements, USCIS has to approve your case.

Basic Requirements for Naturalization As the Spouse of A U.S. Citizen

  • Lawful Permanent Resident for at least 5 years (important note you can submit your application at 4 years and 9 months)
  • 18 years of age and older 
  • Good Moral Character during the five year period 
  • Physically present in the United States for at least half of the five year period with no breaks in continuous presence 
  • Ability to Speak, Read, and Write English & Pass the Civics Test

  • 18 years of age and older 
  • You have been married to your U.S. Citizen spouse for at least three years, your spouse has been a U.S. Citizen for those three years, and you have resided together with your spouse 
  • Good Moral Character during the three year period 
  • Physically present in the United States for at least half of the three years period with no breaks in continuous presence
  • Ability to Speak, Read and Write English & Pass the Civics Test

  • Lawful Permanent Resident – depending on your periods of service there may not be any specific number of required years as a Lawful Permanent Resident prior to applying
  • No filing fee

  • If you are over the age of 50 and you have been a Lawful Permanent Resident for more than 20 years, you do not have to do the English part of the test and can actually do your interview in any language that you choose. 
  • If you are over the age of 55 and have been a Lawful Permanent Resident for more than 15 years, you do not have to do the English part of the test and can actually do your interview in any language that you choose.
  • If you are over the age of 65 and you have been a Lawful Permanent Resident for more than 20 years, you will only have to study 20 civics (history) questions. 
  • If you have a medical or mental health condition that impacts your ability to learn English or the Civics material – you can obtain a certification from a medical doctor which if accepted will exempt you from having to do the English or Civics portions of the interview.

  • Proof of payment of child support – even if you are not on court ordered child support 
  • Proof of payment of taxes and compliance with IRS payment plans 
  • Arrests and/or criminal history during the good moral character period 
  • A single absence from the country for more than 180 days 
  • Excessive amount of time spent outside of the United States 
  • Fraud when originally obtaining green card 
  • Criminal convictions that will make someone removable (could require you to go through removal proceedings before you can Naturalize)

  • The law says the officer has 120 days to make a decision after your interview. 
  • If USCIS fails to make a decision within that time, you can file a lawsuit against them in Federal Court asking the judge to force them to make a decision. 
  • In some circumstances, you can even request that the Federal Judge grant you Naturalization.

  • You have the right to file an appeal, which will usually involve another interview and a senior officer reviewing your case. At that time, you can address any errors made by the original officer. 
  • Sometimes it's all about timing, and you have to just wait a few months or a few years to reapply when you meet all of the legal requirements.
