Client was facing extradition to Lithuania based on pending criminal charges. Fairuze successfully argued that the extradition request was unlawful and did not comply with the treaty requirements against the US Department of Justice before the 4th Circuit Court of Appeals in Richmond, Virginia. As a result of the Court’s ruling, the client was released from custody and the government decided not to proceed with extradition.
Client with no criminal history was charged with Aggravated Assault with a Firearm over a dispute with a tow truck driver, criminal charges that could impact his career. Following jury selection, the State Attorney offered to reduce the charges to a misdemeanor assault and a withhold of adjudication.
Client was charged with Driving While License Revoked as a habitual offender and the state was seeking a jail sentence. Fairuze argued that he was not provided adequate notice of the suspension and that the State failed to meet their burden. The jury returned a verdict of not guilty.
Client was in removal proceedings after the petition to remove conditions on her residency was denied claiming the marriage was a sham. Her ex husband was deceased and nearly twenty years had passed since the application was denied. Fairuze was successfully in getting her I-751 approved at USCIS and the removal proceedings terminated.
Client was in a relationship with a US Citizen who had never properly divorced his prior spouse. Based on the conditions of the marital relationship, Fairuze was able to determine that the client could file as a VAWA Self-Petitioner and his refusal to divorce was not an impediment to the approval of her case. After nearly 25 years in the United States, the client obtained her lawful permanent residence.
Client was charged in federal court with alien smuggling and assault on a federal officer (the most serious charge). During cross examination of the government’s law enforcement witnesses, they admitted that the video evidence did not support the allegations made in their reports. Following a mutli day jury trial, the Defendant was acquitted of the assault on a federal officer - the most serious charge.
Client was a teacher charged with hitting a student who was destroying classroom items. Following the presentation of the case, the judge granted the defense motion for a directed verdict (essentially to dismiss the charges) and ended the case against the client before the case even reached the jury.
Client was charged with first degree murder of her husband. Fairuze sat second chair on this murder case, which received nationwide media attention, in which a battered spouse defense was presented. The client was found not guilty and left the courtroom a free woman.
Client had a removal order from the 1990s. Fairuze was able to successfully reopen his removal proceedings, obtain a military parole in place based on his immediate relative in the US Armed forces, and finally obtain permanent residence for this client who had been living more than twenty years with a removal order.
Client with multiple DUI convictions was detained by ICE and placed in removal proceedings. After being released on bond, the client was re-detained and then re-released on supervision by ICE. Client was subsequently approved for a T-Visa as the victim of human trafficking and the removal proceedings were dismissed.
Client in detention was granted withholding of removal as a result of suffering persecution by the government after participating in peaceful protests in his home country. He was released from custody and obtained employment authorization.
